BARROW COUNTY, Ga. -- A former Barrow County teacher is suing the North Georgia school district, alleging she was forced to step down after photos and an expletive were shown on her Facebook profile.
Ashley Payne claimed the Barrow County school district violated state labor law because she was never told she was entitled to a hearing. Her attorney, Richard Storrs, said the 24-year-old former Apalachee High School teacher was "not made aware of her rights" and should be granted the hearing
She claimed her principal said because her profile page had of pictures of her with beer mugs and glasses of wine from when she went on vacation to Europe, she had to go.
“I visited the Guinness Brewery, I went to Italy and had wine. I went to the Temple Bar District of Dublin and drank some alcohol there like any normal adult would,” said Payne.
Payne and her friends took pictures at various places across Europe. A few pictures showed her with a glass of beer or wine.
“They’re not even of me drinking the drinks and I don’t look like I’m intoxicated in any way or doing anything provocative or inappropriate,” Payne said.
Payne, an English Teacher at Appalachee High, said she was called into the principal’s office where she was told that because of her pictures and an expletive used on one of her posts that she should immediately resign.
“The principal said that he’d talked to the superintendent so he represented that the decision had already been made and that the only way to avoid the suspension on my record would be to resign,” said Payne.
Payne’s Facebook page is private and she doesn’t allow students or strangers to become her friends on the social networking site. Several fellow teachers are included in her pictures including one who was with her on the European vacation.
But Payne is the only one out of a job.
“I did not think that any of this could jeopardize my job because I was just doing what adults do and have drinks on vacation and being responsible about it,” said Payne.
Barrow County school Superintendent Ron Saunders declined comment on the lawsuit because it is a personnel issue.
Payne resigned from her position Aug. 27. She had worked at the school for two years.
Pretty ironic because I know this town/county and it's slammed full of liquor stores and bars. Infact I believe the main city use to be called "Juggstown".

Yeah. Welcome to the Bible belt.
Winder, GA Walmart would be banned from "Peopleofwalmart.com" for being too fucked up. Though her school is actually a very nice area.
From what I have gathered locally she was actually a good teacher who was worth a damn.

Same thing happened at my sisters college (she majored in Special Ed). Student was denied her degree days before graduation because there was a picture of her in a pirate outfit for halloween with a plastic cup in her hand. the caption was "drunken pirate". My sister immediately pulled her page and now has it completely private. She won't even add me.

ridiculous. hell one of our local high school teachers is a bartender. guess they'd faint at the thought of that.

That's pretty messed up. I 'assumed' she was at a party throwing down and half/totally naked or something but just having a glass of wine or a beer in a picture ? Give me a freakin' break.
Sounds like they were just looking for a reason to get rid of her and jumped at this chance.

I'm not talking about binge drinking. But having a glass of wine with dinner, or a beer is widely accepted throughout Europe yet staunchly frowned upon in most of North America. Just find the cultural difference odd.

No, I'm not joking at all. That is the prevailing mentality behind the laws and views on alcohol and drugs in America.

I always understood that the difference was in Europe they don't(or at least used to not) have a good way to filter water so they would ferment things to kill the bacteria or whatever. That's why it is so normal there because water wasn't safe to drink.
That of course doesn't explain why NA has a problem with it, just the difference in the mindset of Euros to Americans.

Hmmm....didn't know that but it would make sense I suppose.
When I was in Germany a tour guide told us all about how beer there is considered a food so employers can't stop you from drinking on the job and it's perfectly okay to drink at lunch.

It's not warm, it's served at the optimum temperature for that type of beer. Cask ale should be served at a warmer (not WARM but warmer) temperature than other ales or lagers. :idk:

I guess it's all relative because room temperature is WARM to me. I like my beer cold and the colder the better. :idk:
I don't drink Cask ale so I wouldn't know.
*edited*
I guess this is the suggested temps for beer and when I said room temperature it was based on what I was told by a friend that just got back from France and was staying in a hotel near the France/Belgium border. :idk:
Wheat beers and pale lagers at fridge temperature, 45-50°F (7-10°C)
Pale ales, English bitter, amber ales or dark lagers at 50-55°F (10-13°C)
Belgian ales, barley wines and similar strong beers at around 55°F (13°C)
Porters, stouts and other dark ales at 55-60° F (13-15°C)
Some of the stronger Belgian beers should be served close to room temperature

This is true. The warmer a beer, the more flavor it has. Why do you think they serve Budweiser at just above freezing? To mask the horrendous flavor.

because America is full of "my shit don't stink, do gooder, perfect life until I get caught then I'll pray for forgiveness bible thumpers" who refuse to believe people could be happy living their life anyway other then the prescribed pentecostal, catholic, or other christian faith of choice way. Their very willing to tell you the err of your ways and how you should be more like them, then you'd be happy.

Right and I also stated it's a relative term so to me if we're talking about beer...soft drinks...milk...etc...if it's not cold...and is room temperature...it's warm.
I didn't mean warm as in heated.
When my meal is warm and I don't eat it in time and it sits there and gets "room temperature" I say it's cold....BUT I'm sure some expert here will be quick to tell me "well it's not cold" as in it's not refridgerated !!

This doesn't sound like the typical case of someone being a complete ass and putting pictures of it up on Facebook. This is a case of a superior believing that a person isn't entitled to a normal life.

I just got an e-mail regarding security clearances and social networking sites. the jist of it is that they constitute a security risk... and can and will cause you to be denied a top level security clearance. they've started asking all the students who need top level security clearances during their interviews if they have them. I coach them all to delete their pages, and to say no.
I've said this here before... but my old room mate and many of my sisters co-workers were fired from Alaska Airlines for having "objective" material on their PRIVATE myspace page. my old room mate had a pic of her and my sis standing next to a male flight attendant... all in uniform, saying "here's Jeanie and I making Will look like a Pimp" they fired her because "you can't refer to flight attendants as PIMPS" :wtf:
anyways... I think I still have mine... but haven't been on them in forever. just don't really care anymore.

Actually, it sounds like a boss who already dislikes an employee, and is searching for a way to justify firing him/her. Not surprising for a school or small business, since their management often consists of seedy people.
I can guarantee you that HR at most firms (at least the large, professional ones) do not waste their time googling each and every single employee, unless they are being investigated for some reason, or being considred for a major promotion
