They had an interim one because of the Democrats. They changed the law to a special election when Kerry left to run for Pres so Romney couldn't appoint a Republican. They changed it again recently to get Paul Kirk appointed so they wouldn't be without a crucial vote for health care. The special election law they put in effect still went against them though.
