That law does not apply in this case. Old Navy did not use a likeness of Kardashian, they merely used an actress who has similar characteristics, and that is not actionable under US law.

Her lawyer either has no access to Google, or is just a bottom feeder.

Given the amount of Bondo in Kardashian, I'd say that the 'look alike' has a better case for HER likeness being appropriated. At least she was born with it.
