alcohol and concealed carry permits

i'm trying to figure out what the laws are concerning being drunk and in possession of a firearm. i know it's a retarded idea but me and my roommate are having an argument about it. if anyone can help i'd appreciate it

Smittie61984 08-12-2009 09:27 PM

If you are in your home and on your property I'm guessing you can get as drunk as you want with as many guns as you want and that's without a concealed or carrying license.

But I'm assuming you are talking about in public locations where a CCW would apply. Here in Georgia I could carry a firearm into a bar (open or concealed) but the bar can deny you too (which is their right). But if I even have 1 alcoholic beverage I'd be in trouble. What kind of trouble, I have no clue.

Amorok 08-12-2009 10:21 PM

In Mississippi you cannot conceal a firearm in a location that makes over 50% of their revenue selling alcohol by the drink. So I can carry in Chili's, but not the Fort Bayou Saloon. There's no specific law about being drunk with a firearm, but it would affect your sentence if you had to go to court. On your own property anything goes, but again, if you're drunk with a firearm and something happens you're getting fried in court.

Actually in GA you CANNOT carry in a "BAR", if you try you will probably be arrested violently ;) The law was recently changed to allow carry in a "RESTURANT" that serves acohol (was prohibited until last year with the change). It is against the law to consume alcohol while carrying concealed or otherwise in a public venue. Before, that law stated that the firearm HAD to be concealed to carry in public, now it can be carried openly from what I understand. Personally I don't like to advertise that I'm carrying. You still cannot wear one in any govt. buildings. I don't thnk you need a permit now to have a loaded firearm in your vehicle, before it had to be unloaded without a permit. Those were the major changes in GA laws recently.

Dragonpaco 08-12-2009 11:26 PM

my main question is, what if you get stopped for drunk in public and you have a gun on you but you also have a concealed carry.

Well I don't believe Georgia has any technical bars. Aren't all places that serve alcohol in Georgia required to be are 70/30 splits. Except for some in cities like Athens or Savannah but I think those are 50/50 splits which I think still classifies them as a restaurant.

The laws are fucked up weird, especially when they clash with federal laws. Which reminds me whatever happend to that Georgia congressman who said he was going to carry a pistol into Hartsfield and pick up his wife?

Either way I say Fuck Em'. 2nd ammendment says I can bear that bitch if I want to. Though private property rights supercede my right to carry on someone's property. Though I wonder if an argument could be made that since the state allows it, a private business can't deny someone the ability to carry a pistol into their place of business (I wouldn't agree but wondering).

All states I know of will put you in jail and strip you of your carry license and could strip you of your ability to obtain a carry license in the future. I don't know of any states that will allow you to carry and drink alcohol.

Don't do it.

Gas Man 08-13-2009 01:13 AM

Yeah that is the trick... you basically cant carry and drink in public. Here's michigan's law on it

http://www.michigan.gov/msp/0,1607,7...0961--,00.html

101lifts2 08-13-2009 01:50 AM

I think it's illegal to even think about a gun in California.

Krypt Keeper 08-13-2009 07:30 AM

Yep don't carry if you plan to drink. Plain and Simple..

Virginia also just recently changed the law to where you could carry and go into a place that serves alcohol.

I personally tend to avoid most eating establishments or store with "NO CONCEALED WEAPONS Guns or knives" signs on their doors.

If its concealed how would you ever know if I have it. (I mostly avoid all places with these signs) Here is a link for a list of those in Virginia http://www.vcdl.org/static/gue.html

I guess I can't carry my Kershaw pocket knife in a restaurant cause I might want to pull it out and hurt someone, yet you serve me a steak with an 8" serrated steak knife.

Yeah, what he said.
For practical reasons as much as legal ones.

Seems reasonable to me.

I dont know PA's exact law...but I know Gov't building are not allowed and I'm pretty certain it's not allowed in bars. As far as actually drinking and carrying...I dont know our laws but I tend to agree with Trip.

z06boy 08-13-2009 10:41 AM

In NC you CANNOT conceal carry with ANY alcohol in your system. You can have a firearm on you but it cannot be concealed.

I have a conceal carry permit and do carry quite often. However if I have been drinking at all and am pulled over or riding in a car that has been pulled over I take the handgun out before the officer comes up to the car and place it on the dash...put my hands in plain view and I don't make any sudden movements without telling the officer about the weapon and also the fact that I'm going to reach for whatever...like my ID...or the registration etc.

I'm not saying I get drunk and drive but what I am saying is I have had a beer and drove and got pulled over while in possesion of a concealed weapon. Before the officer walked up I just pulled it out...layed it on the dash...put my hands at the 10 and 2 position...informed the officer of the weapon just in case he hadn't seen it and told him I had a beer and that's why the weapon was not being concealed.

He took my gun...ran the numbers...looked at some of my ammo in the mag...had me blow into the handheld breathalyzer and then told me to have a good day and sent me on my way. :idk:

I've also been a passenger in a car that went through a license check...I had been drinking but not the driver and I again...placed the handgun on the dash...informed the officer that it was there just in case he hadn't seen it...told him I had a conceal carry but had drank a couple of beers...made no sudden movements and all was ok. :idk:

jtemple 08-13-2009 10:53 AM

NE is the same way. If you have even a trace amount of alcohol in your system, no carrying. There is no "legal limit" for CCW. Now, in your home, that's a different story.

For me, the choice is easy. I'd rather be armed than intoxicated.

Thats probably good practice whether you are carrying or not. Police have a dangerous job. Doing this when you get pulled over will only help the situation.

Me too. I've been carrying concealed for 15 or 20 years and the examples I mentioned above were the only two in all of those years.

I've drank a few more times so I'm not saying they were the only times I've drank...just the only times involving LEO's.

These days I'm usually the DD.

My constitutional rights to carry a firearm are bing violated if the government tells me I can't carry and binge drink at the same time.
or something

So when I go to San Francisco for a week of vacation in September I can't take my gun ? Crap...I was gonna put it in my wife's carry on. :skep:

I guess I'll just ship it to the hotel and pick it up when I get there...ok maybe not. :wtfru:

Bluestreak 08-13-2009 02:02 PM

For me, if I'm going to be drinking, I'm not carrying. The risk is too great.

I've never been pulled over while carrying, but if I were, I'd do what Z06boy did. I'll notify the officer even if I haven't touched a drink. It's just curtosy.

I don't have my CCW but from what you guys are saying is I could never carry concealed anyway because the only time I don't have a beer in me is when I'm at work, sleeping, or hunting/target practice.

I would never condone handling a firearm once you have been stopped. When a cop lights you up, that is not the time to be fiddling with a weapon. If he sees you doing that, you're in a world of shit.

Drink or carry, don't do both.

we were both fairly drunk when the argument was going on but all my guns were safely locked up at the time and his gun was even more safely locked up at the police station. we were pregaming and decided to go to a bar of ill repute and he told me i should take one of my guns with me and i said it was illegal and it went back and forth like that. at no point did i consider touching a loaded firearm while blitzed (did it once with bad results)

See I would never do it this way.

I have yet to be pulled over at all in years let alone with my CCW.

But my bud has always just left the gun where ever it is. Roll windows down if tinted. Hands at 10/2 and simply tell the officer right off as soon as he gets there. "Officer I have a CWP and I am or not carring and the gun is here or there (if carring)." But its important to tell them even if you aren't carrying because in Michigan if they run your plate, it automatically pops up the owner has a CWP/CCW. So best to act the same to put officer at ease.

Of corse with me the wife "owns" the cars and I own the bikes. But I still would do the same regardless.

In canada, alcohol is usually a good excuse to play with guns... 24 beer and rifles in a gravel pit, and youve got yourself a party.

Then when your done, take out the shotgun, throw the bottles in the air, blow to smithereens and repeat...

Doesnt happen much here anymore, but it used to be a regular tthing in these parts.

It depends on the percentage of their revenue. Resturants are places like Red Lobster that serves alcohol is not considered a "bar" and you can carry in them now. All the "clubs, bars, that were in Buckhead were classified as bars that served food. Before this last change you could not carry in any establishment that sold alcohol for consumption on the premises.

I work with cops a good bit and they told me they hate that shit and wish people wouldn't do it. Mainly because they pull someone over for speeding and when they announce they have a gun they have to call another car in and check crap when all he had to do was write a ticket.

He said the way he looks at it is a person who would put a gun on the dash or announce it wouldn't do anything to me anyways. While a person with 5 bricks in the back who would shoot me is going to keep it concealed becuase they want a back up plan for later.

Basically he said don't announce it unless they ask.

Though you should have seen a cops face when my buddies and I had roughly 20 or so guns (belonged to my friend's dad) in the back of a bronco because we were going to a hunting club to shoot them. AR15s, Big fucking revolvers, sniper looking rifles, and multiple bananas. But he was a country cop and thought they were cool.

It might be that way in Georgia but I think the cops just don't want to deal with it. Though I think in Georgia our vehicles are considered an extension of our home. Which in my hood, if the cops asked you if there was a gun in your home and you said "no" they'd probably really get nervous.

Drink or carry, don't do both.

The LEO isn't going to see me do anything. I've been carrying for well over 20years and carry one everyday for a living. I just lay the weapon on the dash way before he/she ever approaches the car...roll the window down...place hands at 10 and 2 and sit still...very still and inform the officer as soon as I open my mouth.

You can't ride around with the handgun laying on the dash. :idk:

90 to 95 % of the time I don't drink if I'm carrying but as mentioned...I carry most all of the time...so if I just happen to have a beer and have it on me it can't be concealed so I do what I need to do.

You do it your way and I'll do it mine.

I work with LEO's...former LEO's...retired FBI...Secret Service...and military and guess what...every now and then they may have a drink and they all do the same exact thing as I do because...it works.

No I don't suggest it for everybody if you don't have your chit together but again...works for me.

It's against the law in NC to pocess a concealed weapon with any alcohol in your system...do that here and you may get a free ride to the crossbar hotel.

Again...my way works for me.

Me too because if you get scared or fumble around or whatever it isn't for you.

Mine is in an unzipped pouch within reach and it's pretty easy to pull it out and lay it on the dash quickly.

I'm only talking IF I have any alcohol which is rare if I'm carrying but it has happened and I'm sure will happen again.

If I'm not drinking like most of the time it's no issue...it stays concealed and I tell the officer about it. :idk:

jtemple 08-14-2009 11:54 AM

I don't feel the need to complicate things with alcohol.

...and you shouldn't but if it ever happens it's good to have a plan and not be the deer seeing the headlights.

It is no doubt BEST not to combine the two.

I have a quick question here. As a non CCW holder here, I wonder if most people who carry semi auto's carry an extra mag or 2, or do they just carry the 1 mag in the gun? You can plead the fifth if you don't want to divulge that info. I was just curious.

Personally I carry one in the pistol and one extra. I also have 2 more that are extra high capacity when I feel the need which is not every day.

Here is my everyday carry "stuff" with the two extra's that I don't always carry.

JUST FOR THE RECORD...I'm no expert...I just do what works for me.

I'm also NOT a Glock cheerleader and try to stay out of those arguments. My Glock was bought for me and I like it and it's accurate for such a small firearm. Some don't care for Glocks and that's fine too.

Fuck, I cant wait till my handgun license gets approved...

We cant CCW here, but damnit I love handguns.

Rider 08-14-2009 12:41 PM

Glock is very good. I have a buddy who is a DEA agent in Detroit and he swears by Glock. He's run 10,000 + rounds through his 23 and has never had a jam or a misfire.

Apoc 08-14-2009 12:49 PM

Its the benefit of loose chamber tolerances. If you keep them clean, a glock shouldn't jam. They are the most reliable guns on the market, but their accuracy suffers a LITTLE compared to closer tolerance handguns, which are more expensive usually, and jam easier if dirty.. (but why would you have a dirty handgun anyway?)

I carry a full size 1911 .45 that takes up enough space on its own without having to carry an extra mag!

Hopefully 8 rounds is enough to get me out of a sticky situation. Hopefully I never need any of those.

I carry an old Ruger P-85 in the console of my truck, 2 spare mags with it (I was a boyscout, what can I say :idk: )

I never divulge possesion of a firearm if I'm pulled over. In most cases it delays you as the cop will likely call for back up and if you sneeze you might get shot ;) If they asked to search the vehicle for some unknown reason I would then tell them where the pistol is and produce my permit at that time. I have talked to cops in our area and they all said they preferre not to know if it's a simple traffic stop, and they get nervous if it's on the dash in easy reach. I've never been pulled over for more than speeding so there's never been an issue.

Its ok, if it wasnt for the fact that every Canadian, on every MC forum is from Ontario except me, nick, and red, I probably wouldnt know where your from either...

Its like motorcyclists outside of Ontario dont exist when you get online. Though Papa is an easterner at heart.

I carry one extra mag. I have two glocks, a 21 and a 27. So far, all I've carried is the 27, but I do have holsters for the 21. It's a bit tougher to conceal.

Dragonpaco 08-14-2009 05:22 PM

i carry an extra mag for my beretta. although if i can't hit whatever i'm shooting at with 15 shots, i really don't deserve the other 15

jtemple 08-14-2009 09:29 PM

An extra mag is also nice to have in the event of a malfunction.

What state did you go with for your CCW?
I have ND and MN, which cover almost all states. When I get back I'll probalby get the UT permit, then I will be covered in every state that allows concealed carry.

As far as mags... I haven't yet had a chance to actually carry, as I have been in uniform since I bought the gun, and you can't carry in uniform.
When I do carry though, I am sure I would carry at least one extra mag. Nothing more worthless than a gun with no bullets!

Just the one most of the time. I simply dont have a seperate mag for all my vechicles and holster doesnt hold the extra. 11 shots needs to be good nuff

As Apoc said... basically a glock is a good ole trusty piece. Not the best but probably one of the most durable!

I have a Michigan CCW/CWP. You just need to check state reciprocity. There are independant websites but I generally always check the states on both sides.

you still need to get NJ. they dont accept any ccw except their own

Lots of great info on this subject. Proarms pull my trigger is full of important info.

One is none, two is one and three should get the job done. If you ever need your gun it better work and it better not be out of bullets. A empty gun is a rock and you only get one throw.
